Prof. Xiang Yu is now a visiting professor of Technology University Munich in Germany. During his visit, he accepted a telephone interview from the China Radio International in English. And this interview was broadcasted in Sep. 6th. During the interview, Prof. XiangYu expressed his opinions on Chinese patent quality.

The host quoted the study of European Chamber of Commerce to point that Chinese patents is in a low quality. The study showed that in 2011 only 32% of Chinese patent applications were new innovation; meanwhile 65% of patents filed by Chinese state-owned enterprises just target low-end patents. And the host also asked about the problems with the existing IPR system or the IPR Laws in China.

Firstly, Prof. Xiang Yu explained that based on the patent application data, Chinese applicants for invention accounted for a large percent of the total number of the inventions in all over the world. And also these data shows the dynamic innovation in China.

Secondly, Prof. Xiang Yu analyzed why some statistics showed the current patent application of state-owned enterprises target low-end patent. The medium-sized and small enterprises as well as the none-state run enterprises have stronger needs or motivations for acquiring the competitive advantages in the market by filing stronger patents. Meanwhile some important inventions held by Chinese state-owned enterprises are need to be kept secrets. It is also possible that before recent years some state-owned enterprises have already filed very important patents, and these years they need to supply utility model and design patents for former inventions.

Finally, Prof. Xiang Yu indicated that after the third amendment of the Chinese patent law in 2008, patent legislation in China is fully accorded with the international standard. In recent years, the patent enforcement in China has also been great improved, and the patent system itself has no big problem, however, the main problem is that there are no enough qualified patent professionals. In addition, Prof. Xiang Yu indicated that the Chinese patent system developed very fast and already fulfilled the international standard, and foreign firms apply to more and more patents in China and the technology transfers to China also increased. About the patent system of Germany, Prof. Xiang Yu pointed that our country has learned much more from Germany before, for the purpose of better encourage innovation and technology transfer, the Germany “employee invention system” and “sample contract of patent licensing and technology transfer ” should also be studied in the future.
