The new regulation regarding customs protection of intellectual property rights in the People’s Repu

  Abstract: Discusses the provisions of the Chinese Regulations Regarding Customs Protection of Intellectual Property Rights 2003 which harmonise the countrys customs enforcement system with the requirements of the Agreement on Trade-Related Aspects of Intellectual Property Rights 1994 (TRIPS). Outlines the amendments made to the previous regime, including to the rules on making requests for customs protection, and customs officials investigation duties. Considers the remaining problems and uncertainties affecting the regime.

  On 2 December 2003, the State Council of the Peoples Republic of China enacted new Regulations Regarding Customs Protection of Intellectual Property Rights of the Peoples Republic of China (hereinafter "2003 Regulations"). The 2003 Regulations supersede the previous Regulations Regarding Customs Protection of Intellectual Property Rights of the Peoples Republic of China of 5 July 1995 (hereinafter "1995 Regulations"). The amended rules are of special importance as they harmonise Chinas customs enforcement system with the corresponding provisions of the TRIPS agreement.
